ELVORA – GENERAL TERMS AND CONDITIONS

1. Introduction

These General Terms and Conditions govern access to and use of Elvora, an educational management platform designed for schools, educational institutions, administrators, staff members, teachers, students, parents, and other authorized users.

By accessing or using Elvora, users and participating institutions agree to comply with these Terms and Conditions.

Where an educational institution provides access to Elvora to its users, that institution is responsible for managing authorized access and for using the platform in accordance with applicable laws and regulations.

2. Elvora Services

Elvora provides digital tools for educational institutions. Depending on the institution's configuration and subscription plan, these services may include:

  • school and classroom management;

  • teacher, staff, student and parent account management;

  • timetables and scheduling;

  • attendance management;

  • educational resources;

  • online classes;

  • notifications and communications;

  • Google Calendar and Google Meet integrations;

  • class recording functionality through Elvora Recorder;

  • cloud storage of authorized recordings;

  • administrative and reporting functionality;

  • other educational management features made available through the platform.

Not every feature is necessarily available to every institution or user.

3. User Accounts and Access

Users must provide accurate information when required and must protect their account credentials.

Users must not share their accounts with unauthorized persons.

Institutions are responsible for assigning appropriate roles and permissions to their users.

Users are responsible for activities performed through their accounts unless unauthorized access has been reported to Elvora or the relevant institution.

Elvora may implement additional authentication and security measures where necessary.

4. Acceptable Use

Users must not:

  • attempt to gain unauthorized access to accounts, schools, recordings, systems or infrastructure;

  • interfere with the security or normal operation of Elvora;

  • circumvent permissions, subscription restrictions, storage quotas or other technical controls;

  • upload or distribute unlawful or malicious content;

  • impersonate another person or institution;

  • use Elvora for unlawful purposes;

  • misuse third-party integrations;

  • attempt to access information belonging to another institution without authorization.

Elvora may restrict or suspend access where misuse, fraud, security threats or material violations of these Terms are detected.

5. Educational Institutions and School Accounts

Each institution using Elvora is responsible for managing its users, permissions, educational information and use of the platform.

Institutions are responsible for ensuring that their use of Elvora complies with applicable education, privacy, employment and data-protection requirements.

Where an institution uploads its name, logo or other branding to Elvora, it confirms that it has the necessary rights to use those materials.

6. Online Classes

Elvora may allow institutions and authorized users to create, manage or access online classes.

Some online-class functionality may depend on third-party conferencing providers such as Google Meet.

Those services are operated by their respective providers and are subject to their own terms, privacy policies, availability and technical limitations.

Elvora does not control and cannot guarantee the continuous availability of third-party conferencing services.

7. Google Services

Authorized users may optionally connect their Google Account to Elvora where Google integrations are enabled.

Depending on the functionality authorized by the user, Elvora may use Google services to create or manage calendar events and associated Google Meet meetings.

Elvora's use of information received from Google APIs is subject to applicable Google API Services policies and the Elvora Privacy Policy.

Users may revoke applicable Google permissions through their Google Account where supported.

8. Elvora Recorder and Class Recordings

Elvora may provide Elvora Recorder, a browser extension designed to allow authorized users to record eligible online classes and securely transfer those recordings to storage configured for the relevant institution.

Recording is not intended to occur secretly or independently of the authorized educational workflow.

Institutions and users are responsible for ensuring that recording is permitted and that all notices, permissions or consents required by applicable law have been obtained before recording a class.

Where students, teachers or other participants are recorded, the institution is responsible for determining whether recording is appropriate and lawful within its educational context.

Users must not use Elvora Recorder to intentionally record unrelated meetings, websites or communications outside its authorized educational purpose.

9. Recording Storage and Retention

Where cloud recording is enabled, recordings may be transferred to cloud infrastructure used by Elvora or configured for the relevant service.

Recording availability, storage capacity, retention periods and quotas may depend on the institution's subscription and configuration.

Recordings may be removed when:

  • an authorized user or institution requests deletion where applicable;

  • a configured retention period expires;

  • applicable storage limits or contractual conditions require removal;

  • an account or subscription is terminated, subject to applicable retention requirements;

  • retention is required or prohibited by applicable law.

10. Content and Data

Users and institutions retain their applicable rights in content they lawfully submit, create or upload through Elvora.

Use of Elvora does not transfer ownership of an institution's educational content to Elvora.

Institutions and users must ensure that they have the necessary rights and permissions for content they upload, record, distribute or otherwise process using the platform.

Elvora may process such content only as necessary to provide, secure, maintain and improve the services, subject to the applicable Privacy Policy and contractual arrangements.

11. Subscriptions and Service Limits

Certain Elvora functionality may require a paid subscription.

Features may vary according to the selected plan, including:

  • number of users;

  • available modules;

  • recording availability;

  • recording duration;

  • cloud storage;

  • usage quotas;

  • administrative functionality;

  • other service limits.

Applicable commercial terms may be provided separately when an institution subscribes to Elvora.

12. Intellectual Property

The Elvora software, source code, interfaces, designs, trademarks, branding and original platform materials are protected by applicable intellectual-property laws.

Except where expressly permitted, users may not copy, modify, distribute, reverse engineer or commercially exploit protected Elvora materials.

Nothing in these Terms transfers ownership of user or institution content to Elvora.

13. Third-Party Services

Elvora may rely on third-party services and infrastructure, including hosting, cloud storage, APIs, authentication providers and communication or conferencing services.

Third-party services may be governed by their own terms and privacy policies.

Elvora is not responsible for interruptions or restrictions caused by third-party systems outside its reasonable control.

14. Privacy and Personal Data

Elvora processes personal information in accordance with its applicable Privacy Policy.

The Privacy Policy explains, among other matters:

  • categories of information processed;

  • purposes of processing;

  • recording-related data;

  • third-party services;

  • storage and retention;

  • security;

  • applicable user rights;

  • contact information concerning privacy matters.

The Privacy Policy must be read together with these Terms where applicable.

15. Security

Elvora implements reasonable technical and organizational measures intended to protect the platform and information processed through it.

However, no internet-based service or storage system can guarantee absolute security.

Users and institutions must promptly report suspected unauthorized access or security incidents affecting their Elvora accounts.

16. Service Availability

Elvora aims to provide a reliable service but does not guarantee uninterrupted or error-free operation.

Maintenance, software updates, infrastructure failures, internet connectivity, security incidents or third-party outages may temporarily affect availability.

Elvora may modify or update technical functionality when reasonably necessary to maintain, secure or develop the platform.

17. Suspension and Termination

Elvora may restrict, suspend or terminate access where:

  • these Terms are materially violated;

  • payment obligations are not satisfied;

  • unlawful or abusive activity occurs;

  • platform or user security is threatened;

  • continued provision of the service would violate applicable law.

Where reasonably possible, appropriate notice may be provided to the institution before material service restrictions are applied.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Elvora shall not be liable for indirect, incidental or consequential losses arising from use of, or inability to use, the platform.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

19. Changes to the Services or Terms

Elvora may update these Terms to reflect changes in its services, technical functionality, business operations or legal obligations.

The current version will be made available through Elvora.

Where appropriate, users or institutions may be notified of material changes.

20. Governing Requirements

Use of Elvora remains subject to applicable mandatory laws and regulations.

Nothing in these Terms is intended to remove rights that cannot lawfully be excluded or restricted by contract.
